General terms and conditions of sale

Anyone who wishes to order a product from the "official shop of the Festival de Cannes" acknowledges having first read the present general conditions of sale. Filling in the order form and confirming it by clicking on the button "I validate my order" is the full acceptance of the items defined below.

The Festival de Cannes Committee has entered into an agreement with the company Alann Mark's diffusion so that the latter manages exclusively its sales shop of its advertising objects offered on www.boutiqueofficielle.festival-cannes.com, www.boutiqueofficielle.festival-cannes.fr, www.officialshop.festival-cannes.com, www.officialshop.festival-cannes.fr.

Is referred to as "customer" any person who connects to the site and acquires or not products.

The "site" is the official online shop of the Festival de Cannes.

Article 2-essential characteristics of products
The qualitative and quantitative characteristics of the products are described on the site. The photographs illustrating, in support of the text, the products, do not enter the contract field. If any errors have occurred, under no circumstances will Alann Mark's diffusion be liable.

Article 3-duration and validity of the offer
The offers of products and their price are valid for the duration of their presence on the site, within the limit of available stocks.

Article 4-registration of the order
Subject to the payment provisions, the order will be definitively registered only after the last validation of the basket summary by the customer. This latter validation shall be assimilated to the handwritten signature referred to in article 1341 of the civil code. As from the last validation, the order is considered irrevocable and can only be called into question in the context of the implementation of the legal withdrawal period referred to in article 6.

Article 5-confirmation of the order
An email confirming the order placed will be sent systematically to the customer. In no event shall the availability of the ordered product be established by sending this confirmation email or by the information on the stock mentioned on the shop site. In case of temporary or definitive unavailability of the product, Alann Mark's diffusion will contact the customer by e-mail, within 8 (eight) working days from the confirmation of the order, to propose to him, what the customer already agrees, either a new delivery time of the product, or a replacement product of equivalent or higher quality, or the cancellation of the order, at the option of Alann Mark's diffusion. In the event of cancellation, Alann Mark's diffusion will fully reimburse the amount paid by the customer.

Alann Mark's diffusion reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of an earlier order.

The products remain the property of Alann Mark's diffusion until the full payment of the prize.

Article 6-withdrawal period
The withdrawal period granted to the customer is 14 free days (against 7 before), from the date of receipt of the products. During this period, the customer may return, at his own expense, the product (or products) not suitable for him. The customer may then choose between, on the one hand, the reimbursement of the sums paid in return for the re-dispatch of the product or products, and on the other hand, the exchange of the product or products ordered. It is understood that the product (s) returned at the customer's expense shall be in good condition, as delivered by the care of Alann Mark's diffusion in their original complete packaging.

The customer must be reimbursed within a maximum of 14 days after exercising his right of withdrawal. The refund will have to use the same payment method unless the customer agrees to another means and the latter does not incur an additional charge.

Failing to do so or if the product (s) are returned after the expiry of the withdrawal period, no Exchange or reimbursement can be made.

Article 7-price, payment and invoicing
The prices of the products are indicated in euros incl. VAT, excluding postage and customs.

The shipping costs are borne by the customer and are calculated automatically according to the weight on the shop site. They are indicated at the end of each order.

Any change in VAT rates will be automatically reflected in the price of the products.

Alann Mark's diffusion reserves the right to modify its prices at any time but the products will be invoiced on the basis of the tariff in force at the time of the registration of the order.

The payment of purchases is made online by credit card by means of a secure payments system.

The product invoice will be inserted into the package containing the ordered product.

Article 8-Exchange
Any change of product, not related to any indirect damage as a result of the present, once the order has been invoiced will not be accepted. However, the customer may request a refund at: festival-cannes@alann-marks.com.
The refund of the product will be made only on condition that the customer certifies the return of the product concerned, at his expense, to the address indicated by Alann Mark's diffusion.

The refund will have to use the same payment method unless the customer agrees to another means and the latter does not incur an additional charge.

Article 9-security of transactions
Alann Mark's diffusion is only subject to an obligation of means for the security of transactions. The secure online payment system is managed under the sole responsibility of its operator.

Article 10-delivery

10.1 General information
The products ordered will be delivered to the address indicated by the customer when registering his order.

10.2 delivery times
Shipments will only commence on May 16.
Delivery times from this date are given as indicative. Alann Mark's diffusion is committed to delivering French customers in 48h, 4 to 10 days in Europe and 1 week in the rest of the world for small parcels. Delays are subject to the constraints of the carriers, a delay could not in any way cause the cancellation of the order or a request for damages. In case of delay and in particular in case of force majeure, the liability of Alann Mark's diffusion will therefore not be incurred for any reason whatsoever. Therefore, no claim for compensation of any kind whatsoever may be submitted by the client.

10.3 mode of transport
It varies according to the destinations and the weight of the packages according to the current tariffs of the B2C Europe network of the company BigBlue, Chronopost International or Colissimo international.

10.4 obligations
Alann Mark's diffusion has an obligation to deliver the purchased property on the date indicated in its commercial offer. In the absence of an indication of a delivery date, Alann Mark's diffusion is obliged to deliver no later than 30 days after the order.
The shipping, delivery or postage charges as well as the possible delivery restrictions must also be included.

Article 11-payment
If the customer chooses to pay by credit card, his order will only be processed when the corresponding amount has been credited to the Alann Mark's diffusion account.
Alann Mark's diffusion reserves the right not to ship the order if the regulation covers only part of the order.

Article 12-transfer of ownership/transfer of risks
The transfer of ownership and transfer of risks will be the signature of the delivery order by the customer.

Article 13 – warranty and after-sales service
In addition to the provisions of article 6 hereof relating to the right of withdrawal which it enjoys in accordance with the law, the customer is guaranteed against the hidden or apparent defects of the products under the following conditions:

13.1 hidden defects
The customer benefits from the legal guarantee against latent defects. Does not constitute a concealed defect a minor defect decreasing only the approval of the product, but without influence on its objective usefulness, i.e. not preventing its normal function. In the event of a non-apparent defect in the product rendering it unfit for use, the customer must promptly comply with the law to send a claim to Alann Mark's mailing by registered letter with request for a notice of receipt at the address following: Alann Mark's diffusion-140 Boulevard Victor Hugo-92110 CLICHY-France. The customer must indicate in his claim the references of the product appearing on the delivery note, the number of the delivery order and the reason for his claim. Alann Mark's diffusion shall, within 15 working days of receipt of the claim, either inform the customer of the acceptance of the claim or notify the client of the reasons for refusal. If the claim is accepted, the customer may return the defective product in its original full packaging, taking care to attach a copy of the invoice. The cost of return will be borne by the customer. Alann Mark's diffusion undertakes to return, at its own expense, to the customer a product in good working condition after repair by the manufacturer. If it prefers to do so, or in the event of failure to remedy the defect, Alann Mark's diffusion will replace the defective product with a new product. In case of definitive unavailability of the product it will be offered to the customer either the delivery of a replacement product of equivalent or superior quality, or reimbursement of the returned product.

13.2 apparent defects and non-conformity
The goods shipped travel at the consignee's risk. The customer is obliged to check the condition of the product and its compliance with the order upon delivery. The customer's signature of the delivery note is a recognition of the good condition of the product and its compliance with the order. If the product is in bad condition or not in accordance with the order, the customer may refuse to take delivery by noting on the delivery note the reason for its refusal and the product will be returned to Alann Mark's diffusion. Within 15 days of receipt of the claim, Alann Mark's diffusion shall notify the customer of its agreement on the defect alleged by the latter. If the claim is accepted, the customer may return the defective product at the expense of Alann Mark's diffusion in its original full packaging, taking care to attach a copy of the invoice. The cost of return will be borne by the customer. Alann Mark's diffusion undertakes to return, at its own expense, to the customer a product in good working condition after repair by the manufacturer. If it prefers to do so, or in the event of failure to remedy the defect, Alann Mark's diffusion will replace the defective product with a new product. In case of definitive unavailability of the product it will be offered to the customer, either the delivery of a replacement product of equivalent or superior quality, or the refund of the returned product. If the claim is rejected, the customer will have to pay the return freight and go in order to receive delivery of the product improperly returned. In the absence of this regulation within one month from the notification of the rejection of the claim, the product will be considered abandoned by the customer, who will not be able to obtain the reimbursement or the delivery or the replacement.

13.3 exclusion
The warranty does not cover the replacement of consumables (batteries, bulbs,...), abnormal or non-conforming use of the product for its intended use, defects related to the intervention of a third party at Alann Mark's diffusion or any external cause.

Article 14-terms of use of the site

14.1 the customer undertakes to comply with the applicable electronic commerce regulations.

14.2 it is brought to the client's knowledge that all photographs, illustrations, texts and models of products reproduced and represented on the site are objects of intellectual property rights.
As such and in accordance with the provisions of the code of intellectual property, the client undertakes not to reproduce, represent or disseminate in any way whatsoever and to whatever title these photographs, illustrations, texts and models of Products, under penalty of prosecution and convictions on the basis of counterfeiting.

Article 15-nominative information
Pursuant to law n ° 78-17 of 6 January 1978 relating to data processing, files and freedoms, the information requested from the client is necessary for the processing of its order and is intended for the services of the company. The customer has a right of access to the information concerning him. Upon request, they may be communicated to the applicant and, in the event of error or modification, be rectified. The customer may also oppose that they are communicated to third parties by sending a letter to the company at the following address: Alann Mark's diffusion – 140, Boulevard Victor Hugo-92110 CLICHY.

Article 16-liability

16.1 the client must ensure under his sole responsibility that he has the right and capacity and in particular the legal majority in order to be able to access the site and acquire the products, in the light of the legislation applicable to him.
It undertakes, inter alia, to check with the local authorities that the products are not subject to specific prohibitions, restrictions or regulations. The products proposed comply with the French legislation in force. The company shall not be liable for any failure to comply with the legislation of the country where the products are delivered.

16.2 the liability of Alann Mark's diffusion shall not be liable for any consequential damages as a result of the present, including loss of profit or loss of opportunity.

16.3 the liability of Alann Mark's diffusion shall not be incurred in the event of any malfunction of the site linked to failures of the public electricity service, cable telecommunications networks or to Internet connection interruptions due to the various public or private operators or providers.

16.4 alann Mark's diffusion cannot be incurred in the event of non-compliance with the legislation of the country of delivery. It is the customer's responsibility to check with the local authorities the possibilities of importing and/or using the products that the customer orders.

Article 17-completeness
The general terms and conditions of sale represent the entirety of the rights and obligations of the parties concerning the orders of products on the Internet.
No general or specific conditions communicated by the client will be enforceable against Alann Mark's diffusion. In the event that one of the clauses of the General conditions of sale is void or deemed unwritten by reason of a change in legislation, regulation or by reason of a court decision, this shall in no case affect the validity of the terms General sales defined here.

Article 18-applicable law and litigation
The general terms and conditions of sale are subject to French law.
In the event of difficulties relating to the interpretation or application of the General conditions, the Parties shall endeavour to resolve their dispute amicably as far as possible. In case of failure of these attempts any disputes which may be given by the General conditions of sale must be brought before the competent courts of Nanterre.
